Frequently Asked Questions
Answers to common questions about Michigan family law, immigration, and personal injury from Haque Legal, PLC in Bloomfield Hills.
Family Law Questions
How long does a Michigan divorce take?
Michigan requires a 60-day waiting period when the spouses have no minor children and 180 days when they do. A contested case with disputes over custody, support, or property takes longer.
Who can file for divorce in Michigan?
One spouse must have lived in Michigan for at least 180 days and in the filing county for at least 10 days before filing. Michigan is a no-fault state, so you do not need to prove wrongdoing.
How does Michigan decide child custody?
Courts decide custody based on the best interests of the child, using the factors in MCL 722.23. They also look at whether the child has an established custodial environment with one or both parents.
Does Haque Legal handle custody and parenting time changes after a divorce?
Yes. We handle post-judgment motions to change custody, parenting time, and support when circumstances have changed.
What should I do if my spouse already filed for divorce?
Respond promptly. After you are served, you have a limited time to file an answer, so contact us as soon as you receive papers.
Immigration Questions
Can I get a green card through marriage to a U.S. citizen?
Often, yes. Many spouses of U.S. citizens can apply for a green card without leaving the United States. Eligibility depends on how you entered, your immigration history, and any criminal record, so a consultation is the right first step.
Does Haque Legal represent clients in Immigration Court?
Yes. We represent clients in removal proceedings, including hearings at the Detroit Immigration Court, and in appeals to the Board of Immigration Appeals.
What should I do if I received a Notice to Appear?
Do not ignore it. A Notice to Appear starts removal proceedings, and missing a hearing can result in an order of removal. Contact us right away and bring the notice and any other immigration papers you have.
Can you help if USCIS denied my petition or application?
Possibly. Depending on the denial, options can include an appeal, a motion to reopen or reconsider, or a new filing. Deadlines are short, so bring the denial notice as soon as you receive it.
Can you help with a Request for Evidence or Notice of Intent to Deny?
Yes. We prepare responses to USCIS requests for evidence and notices of intent to deny. The notice states a deadline, so contact us promptly.
Personal Injury Questions
How long do I have to file a personal injury lawsuit in Michigan?
Most personal injury claims in Michigan must be filed within three years of the injury. Some claims, including those against government entities, have much shorter notice deadlines, so do not wait.
What should I do after a car accident in Michigan?
Get medical care, report the accident, and notify your own auto insurer promptly. Keep records of your treatment, bills, and missed work, and avoid giving a recorded statement to the other driver's insurer before speaking with an attorney.
Can I recover for pain and suffering after a Michigan car accident?
Often, but Michigan sets a threshold. You generally must show a death, a serious impairment of body function, or a permanent serious disfigurement caused by the accident. An attorney can evaluate whether your injuries meet it.
What are no-fault (PIP) benefits?
Personal protection insurance benefits come from your own auto policy regardless of who caused the crash. They can cover medical expenses, wage loss, and attendant care. Claims can generally recover benefits incurred up to one year before the lawsuit is filed, so late filing can cost you benefits.
What if my insurer stopped paying my benefits?
Contact us. Insurers sometimes terminate or reduce benefits, and you may have the right to challenge that decision.
