What is Michigan No-Fault insurance?
Michigan operates under a No-Fault auto insurance system. After an auto accident, your own insurance company pays for your medical expenses, wage loss, and certain other benefits — regardless of who caused the accident. These benefits are called Personal Injury Protection (PIP) benefits. Separately, you can sue the at-fault driver for non-economic damages (pain and suffering) only if you suffered a serious impairment of body function or permanent serious disfigurement, or for economic damages above what No-Fault covered.
How long do I have to file a personal injury claim in Michigan?
Michigan's general statute of limitations for personal injury claims is three years from the date of the accident. However, claims for No-Fault PIP benefits have shorter deadlines — typically one year from the date of the expense. Wrongful death claims also have specific timing requirements. The honest answer is that you should consult an attorney as soon as possible after a serious accident — waiting can cost you both legal rights and the ability to gather evidence while it's still available.
Will my case go to trial?
Most personal injury cases settle before trial — but only when the insurance company makes a fair offer. The reality is that insurance companies offer fair settlements primarily to attorneys who have demonstrated they will actually try a case if pushed. We prepare every case as if it will go to trial. That preparation usually leads to a fair settlement; when it doesn't, we are prepared to present your case to a jury.
How are personal injury settlements calculated?
Settlement value depends on multiple factors: the nature and severity of your injuries, available insurance coverage (the at-fault driver's policy and any underinsured motorist coverage on your own policy), economic damages (medical bills, lost wages), non-economic damages (pain and suffering), fault allocation, and the strength of evidence supporting your case. There is no formula — every case requires individual evaluation. Insurance companies often make initial offers far below fair value; experienced representation typically increases recovery significantly.
What if I'm partly at fault for the accident?
Michigan uses a "modified comparative fault" rule. You can recover damages even if you were partially at fault, as long as your fault is 50% or less. Your recovery is reduced by your percentage of fault — for example, if you are 20% at fault and your damages are $100,000, you recover $80,000. If you are more than 50% at fault, you cannot recover non-economic damages (pain and suffering), though you may still recover economic damages.
What does "no fee unless we win" actually mean?
Personal injury cases in Michigan are typically handled on a contingency fee basis — meaning the attorney's fee is a percentage of the recovery, paid only if there is a recovery. If we don't recover anything for you, you owe no attorney fees. The percentage is typically one-third of the recovery, though it can be different in certain situations. We discuss the fee structure clearly at the initial consultation, and the agreement is in writing before we begin work.
What should I do immediately after a serious accident?
Get medical attention immediately, even if you feel "okay" — many serious injuries (concussions, internal injuries, soft tissue damage) become apparent later. Call the police and get an official accident report. Photograph the scene, vehicle damage, and any visible injuries if you can. Gather contact information from witnesses. Notify your own insurance company. Do not give a recorded statement to the other driver's insurance company. Then call an attorney before signing anything.
How long does a personal injury case take?
Timeline depends on the complexity of the case and whether it can be settled or requires litigation. Straightforward cases with clear liability and modest injuries can settle in 4–9 months. Cases involving serious injuries usually take 12–24 months because medical treatment must reach maximum medical improvement before the case can be properly valued. Cases that proceed to trial can take 18–36 months from filing. We give an honest timeline estimate at the initial consultation based on the specific facts of your case.
Can my No-Fault benefits be cut off?
Yes. Insurance companies regularly terminate or reduce No-Fault PIP benefits — sometimes legitimately, often improperly. Common tactics include hiring "independent" medical examiners who minimize injuries, demanding extensive paperwork, and disputing whether expenses are "reasonable and necessary." If your benefits have been denied or terminated, you have legal rights — and Michigan law allows for recovery of attorney fees in successful PIP litigation, which is why we're able to take these cases on contingency.
