Divorce Without Children in Oakland County
Without minor children, a Michigan divorce has fewer moving parts: no custody, parenting time, or child support, and a shorter minimum waiting period. But the financial decisions are just as permanent. Two incomes usually mean two sets of retirement accounts, shared real estate, and debts in both names.
Haque Legal represents Oakland County clients in divorces without children, from short marriages with premarital assets to long, dual-career marriages. We move efficiently when spouses agree and prepare fully when they do not.

60-day minimum
A judgment cannot enter until 60 days after the complaint is filed when there are no minor children (MCL 552.9f). That is a minimum, not a promised completion date.
No custody or Friend of the Court process
Without minor children, there is no custody, parenting time, or child support, no SMILE program, and usually less Friend of the Court involvement.
Residency
One spouse must have lived in Michigan for 180 days and in the filing county for 10 days before filing (MCL 552.9).
No-fault grounds
You do not have to prove wrongdoing (MCL 552.6). Conduct can still matter for property division and spousal support.
Fewer issues, same permanence
Without children, the judgment is mostly about money and property, and most of those terms cannot be changed later. Property division is generally final once the judgment enters. That makes the details worth getting right the first time.
Start with a complete list: accounts in each name, the home or condo, vehicles, retirement plans, and every debt. Then decide what each spouse wants to keep and how the numbers balance.
01Inventory
Bank, investment, and retirement accounts; real estate; vehicles; and debts.
02What each spouse brought in
Premarital accounts and inheritances, with statements showing their value.
03A workable agreement
Who keeps what, refinancing deadlines, transfers, and any support terms.
What gets decided without children
Property, debt, and support terms affect each other. Agreeing to one without understanding the others can create a judgment that is hard to carry out.
Retirement accounts
The marital portion of 401(k)s and pensions is divided by court order or offset. Premarital balances may be separate if traced.
Debt
Credit cards, car loans, and student loans are divided along with assets. A judgment does not bind creditors, so refinancing and payoff terms matter.
Spousal support
Support can be awarded, waived, or limited by agreement. Michigan has no fixed formula. Spousal support
Pets
Michigan generally treats pets as property, so ownership and care can be addressed in the agreement.
Restoring a former name
A spouse can ask to restore a former name as part of the judgment.

How an Oakland County divorce without children moves
- Filing. The complaint is filed in the Oakland County Circuit Court, Family Division.
- Service and answer. The other spouse is served and generally has 21 days to answer, or 28 days if served by mail or outside Michigan.
- Disclosure. Financial information is exchanged. In agreed cases this can be informal and quick.
- Agreement or mediation. Terms are negotiated directly or in mediation.
- Judgment. After the 60-day minimum, a consent judgment can enter, often at a short final hearing.
- After judgment. Retirement division orders, deeds, refinancing, and account transfers are completed.

Divorce without children FAQs
How fast can we divorce without children?
A judgment cannot enter until 60 days after filing. Agreed cases can often finish soon after that. Disputed property or support issues take longer.
Can one lawyer represent both of us?
No. A lawyer can represent only one spouse. The other spouse may hire their own lawyer or represent themselves, and the agreement can still be reached cooperatively.
Do we have to go to court?
Usually only briefly. In many agreed cases, one spouse attends a short final hearing to place the judgment on the record.
Can I get spousal support if we have no children?
Possibly. Spousal support depends on factors such as the length of the marriage, earning abilities, and needs, not on whether there are children. It can also be waived by agreement.
Who keeps the house or condo?
There is no automatic rule. One spouse may refinance and keep it, buy out the other, or the property may be sold. Down payments from premarital funds may be traceable as separate property.
What if my spouse will not sign or respond?
The case can proceed without agreement. If your spouse does not respond after being served, the court may enter a default judgment.
Can I change my name back?
Yes. You can ask to restore a former name as part of the divorce judgment.
What happens to our pets?
Michigan generally treats pets as property. Who keeps a pet, and any shared care arrangement, can be written into the agreement.
Is the consultation free?
Yes. The initial consultation is free. We explain fees for your situation at that meeting, before you decide whether to hire the firm.
