Who is entitled to a Concealed Pistol License (CPL) in Michigan?

|

For you to get the Concealed Pistol License (CPL) eligibility in Michigan, we have already told you about the first things that you should have. Let us continue.

Completing an appropriate pistol safety training course or class.

In the state of Michigan, you must take the appropriate pistol safety training course before you are even allowed to apply for the concealed pistol license.

A pistol safety training course is important because it shows you the responsibilities and obligations that you have when you are a license holder of a concealed pistol in Michigan.

Do I need to take the class in person or is there an online class?

Given that it is a pandemic some individuals are asking if they can only take an online class relating to the people safety training course. However you must know that since getting a CPL is not a necessity, there is no clear sight of allowing a mere online class to be considered as an appropriate pistol safety training course.

Here at Haque Legal, we always tell our clients that it would be easier for them to get an actual class than to have an online class since there is no assurance if the document processor would allow such course/

You must not have been subjected to an order or disposition of the following:

Involuntary hospitalization or involuntary alternative treatment

You must not have been subject to involuntary hospitalization or any kind of involuntary alternative treatment to treat a mental illness. Being mentally capable of handling the use of a pistol is a requirement for one to be allowed a license to carry a pistol.

Legal incapacity

If you have been declared by the court to have legal incapacity then your gun rights are also affected by it. Legal incapacity, or the removal of your legal rights to act without the supervision of another person, is a big problem.

Personal protection order

If a person has filed a personal protection order against you, you will not be allowed to get a license for carrying a weapon that can cause damage or hurt to others.

As we have stated in our articles, a personal protection order is an order made by the court requiring a person to stop getting within the vicinity of another person or stop making threats.

It is highly improbable for the court to allow you to carry a weapon if it has been proven that a personal protection order has been filed against you in a court of law and that it has been proven.

Bond or conditional release prohibiting purchase or possession of a firearm

When you have been convicted of another felony or misdemeanor, which would also be discussed in another part of this article series, you would have to face the reality that you may not be allowed to own, purchase, or possess a firearm.

A court finding of not guilty because of insanity

If you have been arrested before and you have been put on trial for a crime but was later on acquitted not because of the merits of the case but because of insanity it is highly improbable that you will be allowed to carry or own a firearm. This goes back to the requirement of being mentally stable for you to be entrusted with the big responsibility of carrying a weapon.

You must not be prohibited from possessing, using, transporting, selling, purchasing, carrying, shipping, receiving, or distributing a firearm under MCL 750.224f

There are some feminism or misdemeanors that will prohibit you from telling or using or distributing any kind of firearms and this would include pistols.

You should never have been convicted of a felony in Michigan or elsewhere

You should never be convicted of a felony and misdemeanor or anywhere else in the United States for you to be allowed to carry a pistol or have a license to carry a pistol in the State of Michigan.

There must be no felony charge against the applicant that is not pending in Michigan or elsewhere at the time he or she applies for a CPL.

Post to be convicted of a felony there should also be no felony charge that is against you when you apply for the license.

Finally, you should not be dishonorably discharged from the United States Armed Forces.

The next part of the series let us discuss misdemeanors and the felonies that would affect your right to carry a pistol in the state of Michigan
