What are the violations that may remove my HYTA status?

|

There are some specific violations that we have already discussed in the HYTA status. Let us continue discussing them:

Failure To Follow Probation Requirements

Failing to follow the rules and terms of your probation is one of the surefire ways for you to get removed from your HYTA status. Your probation is one of the ways that the state and the courts check if you are ready to join society as a completely free individual. When you fail to follow the rules of your probation you are showing the court and all of the other individuals involved in the proceedings that you do not deserve the freedom that you are applying for.

Keep in mind that you should follow the requirements of your probation because your failure to do so does not just only remove you from the status that you work hard to get but it means that you will be paying for all of the penalties that you were originally supposed to do.

Failing Random Drug Testing

There are some instances where you may need to get randomly drug tested. Random drug testing is a way for the Courts to check if you are following all of the rules set and if you are not straying away from the past that they are trying to remove you from.

Failing your random drug test could not just mean the removal of your HYTA status but it could also mean that you will be removed from the freedom that has been granted to you.

Failing Random Alcohol Testing

There are also some instances where you would have to face random drug testing. This is the test that is conducted by the court to check if you have been drinking. If the terms of your freedom depend primarily on your sobriety, you are in big trouble if it is found that you failed your blood alcohol test.

Committing A Crime While Under HYTA Status

In one of our previous articles we have informed you that you may use and apply for HYTA status more than once and we mean that. However, we also informed you that it would be harder and more complicated for the second or third time and any subsequent time, this is the reason why.

Committing a crime under the HYTA status means that you violate your HYTA privilege. As such, proceedings may be conducted if your case has yet to be dismissed and you will have to face the consequences of your first violation. Add the second violation while you are under HYTA status and you may lose it.

Not Complying With The Education Requirements

Not complying with the requirements that you should get higher education or finish high school is another problem that you would have to face that could lead to a removal of your HYTA status.

Now that you know the ways and the reasons as to why you may lose your HYTA status, let us look at the courts and the determination that they go through in the process of removing your HYTA status.

Do I need a lawyer to handle my HYTA case?

Yes, you need to have a lawyer who can handle your case especially in terms of the legal geography and the strategy that you need to play for you to get a favorable HYTA decision from the court.

Keep in mind that granting you this status is not mandatory on the part of the court but it is discretionary. There are still requirements and terms that you should comply with for you to get the protection that is provided for by the HYTA status.
