How To Get Your Driving License Back in Michigan: Part One

|

Losing your driving privileges is one of the worst effects of having legal problems when it comes to your driving. For one reason or another, you may think that your driving privileges are just privileges that you do not have in your life but that is not it is already a given fact that the best way that you can drive is to make sure that you drive with the right license.

In the state of Michigan or probably anywhere else in the world, you are just digging yourself an even bigger hole if you drive even though your license has been revoked. You do not need to worry though because there are some ways that you can continue enjoying the privileges of your driver’s license while you get your license reinstated but these are all limited.

Here at Haque Legal, we suggest that you do your best to never get your driver’s license revoked.

What are the ways that you can get your license revoked?

We always say that prevention is better than cure and we know this for a fact. If you do not want to get your license revoked you need to make sure that you prevent the following from happening:

Getting a DUI Conviction

One of the surefire ways for you to lose your license is to get a conviction on DUI. Operating a motor vehicle under the influence of controlled substances or alcohol is a very big sin in the state of Michigan. Other than the very strict application of the penalties, people who are found guilty of DUI are faced with revocation of their license. If you are charged with a DUI, reach to a Southfield DUI/OWI attorney today.

Refusing to submit to a breathalyzer

When you are pulled over you will undergo field sobriety tests or breathalyzers that would assess whether or not you have the blood alcohol content that is not allowed while driving. As we have discussed in the previous article, while you are allowed and you are within your right to reject any kind of test happening in the field or when you are pulled over this still comes with its problems.

When you refuse to get tested through a breathalyzer the police officers may take you into custody if they are sure that you are drunk and your blood alcohol content is beyond the allowable content under the state law of Michigan. If there is only suspicion and you are still acting anyway as if you are sober, the police officer may confiscate your license and just give you a paper permit.

The paper permit is not a replacement for the driver’s license that has been destroyed by the police officer. A paper permit is a form of leeway given to you by the state of Michigan so that you can still drive to and from work until the day of your administrative hearing. If it has been proven that you were indeed not drunk at the time that you were pulled over the whole thing goes away but if it has been proven that you were drunk through evidence presented and gathered by the police you will be facing very serious charges.

Having Too Many Points On Your Driving Record

Some people have the best driving record such that they have no points that affect their deductible and their insurance payments. Some individuals may have too many points on their driving record that force the state of Michigan to pull out their driving privileges until they renew their commitment to following all of the rules.

Having too many points on your driving record is not a good record at all. The higher the number of points that you have on your driving record the more violations it is that you have committed while you are driving.

Violating Insurance Laws

Violating the no-fault policy and the insurance laws in the state of Michigan is also a cause for your driver’s license to be revoked. If you have noticed in many of the articles that we have written about the insurance policies and the application of the no-fault rule in the state of Michigan, the state is very strict when it comes to its insurance laws. Hence, a violation of it could lead to detrimental issues.

Using Your Vehicle While Committing A Felony

Using your vehicle while you are committing a felony is another one of the best ways for you to remove your driving privileges. This is a natural consequence of using a motor vehicle for a purpose other than what it is intended to.

The Revocation Is Not Permanent

The revocation of your driver’s license is not permanent. There is a chance for you to still get back your driving license in the state of Michigan. In the next part of this article series, we will talk about the process of getting back your driver’s license in Michigan.

However, please keep in mind that prevention is still better than cure. And you should always make sure that you do not commit the mistakes listed above so you can have a chance to not get your license revoked in the State of Michigan.
