Evidence Against Negligent Dog Owners

|

Having the best neighbors is a blessing. There are a lot of people who want to have good neighbors but we cannot all get that. In this article, we discuss one of the nightmares that homeowners could have – having a bad neighbor who is a negligent dog owner.

What if it is the other way around? What if you have a neighbor who has an aggressive dog and you want to build a case against them?

To build a strong claim, you need to at least have the following

  • documentation of ownership;
  • eyewitness testimonies of the attack;
  • reports of previous bites or aggressive behavior; and
  • vaccination records.

Let us discuss these pieces of evidence.

Documentation of ownership

To get your neighbor for liability for the dog attack or the behavior of his dog, you need to have documentation that he is the owner of the dog. These can be photos on social media and photos that will prove that the dog is under the care of your neighbor.

Eyewitness testimonies of the attack or attacks

Eyewitness testimonies of the attack in the form of letters or affidavits are also great examples of evidence that you can use. These testimonies can also be presented in court.

Reports of previous bites or aggressive behavior

Any showing of aggressive behavior is good evidence to show that the dog is not good for the community. In some instances, CCTV footage can be used by the plaintiff or by the community to prove that the dog is aggressive and should not be in the community.

Vaccination records

Vaccination records, or the lack of them, can be a good indicator of negligence on the part of the dog owner. Vaccination records, or getting a dog vaccinated, is a dog owner’s responsibility.

If you can submit the pieces of evidence that we have shared, you have a better chance of handling your vaccination records properly.
