Who is a minor? 

A minor is a person who is under the age of eighteen. Under the law, a minor cannot legally act for himself. Only a competent adult who is over the age of eighteen must be appointed before a lawsuit is filed in court. A settlement can only be received once a competent adult is appointed. 

Rules to follow

In the State of Michigan, there are specific rules to follow. If a lawsuit has not been filed in the circuit court, any settlement is governed by the probate rules. 

For a settlement for a child victim of personal injury, it must be held in a restricted account for the use of the child who is injured. 

If the settlement is less than five thousand dollars, the settlement proceeds need not be held in a restricted account. 

The court must issue approval before a minor child and a parent can accept a settlement in a personal injury case. 

Powers of the Court

The Court has the following powers in case of a personal injury of a child:

  • A judge can refuse a settlement. In the course of the determination, if the judge finds that the settlement provides inadequate compensation for the severity of the injuries or trauma sustained by the child, then the judge may refuse the settlement offer.
  • A judge may direct where the money is awarded. The money awarded to a child can be directed to an account where the money is held or invested so the money is not squandered by either the minor or their parents.
