What Happens If You Win Your Driving License Restoration Case?

In some instances, it may happen that you will win your case. After the completely tedious process of going through the hearings and the application and the forms that you have to comply with, winning the case is certainly an outstanding feat. 

Will I automatically be able to drive after winning the case?

No, you will not automatically be able to drive after winning the case. You may still be required to serve a mandatory period of revocation. This is a period that is required by the court or by the law to make sure that you at least learn the message that they are trying to teach you.

Even after serving the mandatory period of revocation, you may still be asked to go through some restrictions and requirements before you get the complete freedom that you want to have.

This goes back to the fact that driving in Michigan is a privilege and it doesn’t always pan out that you would win your appeal so if you do you must always follow the restrictions while you are still being closely watched and monitored by the state. 

What are the restrictions that could be imposed?

There are different kinds of restrictions that could be imposed by the court for you to be able to drive again. In some instances, the restriction is limited to where you can drive to work but some restrictions require the installation of a Breath Alcohol Ignition Interlock Device (BAIID). In other restrictions, some would only be allowed to drive during designated days or the designated hours. Let us discuss them below. 

Restriction on Places To Drive On

There could be a restriction on the places that you can drive on. This is often the restriction that is placed on you when you need to drive to and from work but you are no longer allowed to drive anywhere else. 

Will I be caught if I drive somewhere else not for my work?

This is a tricky question. We have some clients ask the same questions and see that they would also need to drive for purposes other than going to work. Some clients even ask if they can go somewhere else from work to another area and then drive back home. Our answer would always be the same: you need to follow the restrictions on your driver’s license.

As we have stated above the restriction for your driving is only limited to a period of one year. This means that for that one year you need to follow every single rule and every single limitation that has been set for your driving privileges. Any failure on your part to follow the restrictions would be taken against you when you go for the full restoration of your driver’s license and your driving privileges in Michigan. 

Restriction on Designated Days and Designated Hours

Some restrictions are limited on designated days or designated hours. The restrictions placed by the court depend primarily on the charge that you have. 

In one case that we have handled, the individual was asked by the court to restrict his driving from Monday to Friday and only during the day. This was because the client was unable to drive properly at night and had a small accident. This was considered by the judge in requiring him to not drive at night and during the weekends. 

Breath Alcohol Ignition Interlock Device (BAIID)

There is also the imposition of the Breath Alcohol Ignition Interlock Device (BAIID) as a restriction. We will also discuss this in length in another article.

How long would the restrictions last?

The restriction would last depending on how well you comply with it. More often than not at least one year is required before you file an appeal for the full restoration of your license. It is only at this time that you will be able to fully drive without any kind of requirement coming from the state and have the same restrictions as everyone else driving in the state of Michigan.
