Broad Form Collision Insurance in Michigan

|

Accidents happen every day. Nobody can predict when an accident may happen. However, even if you cannot predict when the accident may happen, you may at least prepare for it.

In the article Everything You Need To Know About The Accidental Death & Dismemberment Insurance in Michigan, we have discussed accidental death and dismemberment insurance in Michigan. Since the release of that article, we have received a lot of calls and queries about the other kinds of insurance that are available in the state of Michigan.

To reiterate, in the United States, accidents are the third leading cause of death. For people between the age of 25 to 44, it is often the cause of death. Of course, this is why it makes sense to have a comprehensive insurance policy that could cover your needs, or your family’s needs when an accident happens.

Here at Haque Legal, it is our Southfield personal injury lawyers’ goal to make sure that you have the protection you need in times of trouble. We want to answer all of your questions and therefore we have created this article series that would discuss everything you need to know about car insurance coverage in the state of Michigan.

In the previous articles, we have discussed the mandatory insurance coverages that you should be able to have if you own a vehicle in Michigan. With that, this article now looks at the optional car insurance coverage in Michigan. Let us continue.

Broad Form Collision Insurance in Michigan

The second kind of collision coverage in Michigan is the broad form of collision coverage. Here, the insurance company shall pay for the collision damage to the insured vehicle, regardless of who is at fault.

The deductibles in the insurance shall be waived if the operator of the vehicle is not substantially at fault in the accident. This is assessed in law when the action or the inaction of the individual was more than 50% of the cause of the accident.

What are the highlights of the broad form collision in Michigan?

The broad form collision in Michigan is characterized by the following features:

  • The insurance provider pays for all of the costs that is relating to the repair of the vehicle regardless of who is at fault; and
  • The deductible is waived and no deductible must be paid when the operator or the driver of the covered vehicle was not substantially at fault.

Limited Collision Insurance Coverage

The third kind of insurance coverage is limited collision insurance coverage. According to the Michigan Insurance Code, the limited collision coverage will only fully apply when the plan holder is not the one at fault at the time of the accident.

There are two kinds of limited collision insurance coverage – the one with a deductible and the other one without a deductible.

Limited Collision Without A Deductible

Limited Collision Without A Deductible is one where the insurance company pays for the covered vehicle that is damaged as a result of the auto accident. No deductible is paid by the driver. This applies when the driver is not substantially at fault at the time of the accident. The meaning of substantially at fault is when the action or the inaction of the driver was at more than 50% and relating to the cause of the accident.

What if I get limited collision insurance coverage without a deductible but I am more than 50% at fault for causing the accident?

If you get this kind of collision coverage and you are found to be more than 50% at fault, you will have no benefits or coverage to speak of and you will be forced to pay the expenses for the repair at your own cost or expense.

Limited Collision With A Deductible

The second type of collision is a limited collision with a deductible. Here, the owner of the damaged vehicle is required to pay a deductible before the insurance company would even begin to process the payment of the vehicle damage repairs. This applies even if the operator or the driver of the insured vehicle was not the one at fault for causing the accident.

What is the difference between the two types of limited collision coverage with a deductible?

Under the two types of limited collision coverage, if the operator or the driver of the vehicle was more than 50% at fault in causing the accident, there shall be no benefits or coverage that will be provided to the individual claimant and the vehicle owner would have to pay out of his pocket.

Fault Matters

Despite the state of Michigan being a no-fault state, the coverage of insurance companies in a state of Michigan, especially those who get collision insurance coverage should consider their fault in the accident. Been discussed in the previous sections when there is a fault or when the claimant is substantially at fault in causing the accident the parties should expect that they would not get anything from the limited collision insurance company.
