In law, this limitation is known as the statute of limitations. It affects any case, regardless of the guilt or fault that an individual has in relation to a case.

How long do you have to file a personal injury lawsuit?

In the State of Michigan, you have up to three years in order for you to bring a personal injury lawsuit to court against a party at fault. If you do not get your lawsuit started based on this limitation, the court may refuse to hear it and you will not have any other recourse since you are already bound by the limit set by law.

Generally, the limit starts on the date of the accident. However, if you do not discover that you have been injured for some time after the accident or that there was no way for you to know that you have already sustained an injury, the three-year clock may start running on the discovery date instead.

What if the injury is against a government agency?

If the personal injury is to be filed against a government agency, the injured has to take note of the following periods:

  • 120 days if it is related to a defective highway or a public building;
  • six months to file a formal claim; and 
  • Two years if the formal claim is denied.

The formal claim is the initial action, where your right to file a claim depends on.
