What to Expect When You File Your Personal Injury Case in Court?

|

When you file a personal injury lawsuit in court, there are a couple of things that you need to expect. As we have already discussed a lot of the things that we need to discuss on the matter, we should now look at what to expect when you and your lawyer have already decided on what you can expect to file in court.

It is always a good idea to know what is ahead before you dive headfirst into what will happen when you file a lawsuit.

Filing Your Personal Injury Case in Michigan

There are a lot of ways that you can file your personal injury case in Michigan. First, you have to know whether your case falls within the statute of limitations.

  • General negligence cases have a limitation of file for 3 years.
  • Car accidents or those car crashes in Michigan that led to bodily injuries can be filed for 3 years.
  • Medical malpractice cases can be filed within 2 years.
  • Nursing home abuse can be filed within 2 years.
  • Dog bite cases can be filed within 2 years.
  • Slip and fall can be filed within 3 years.

As long as you and your lawyer were able to file for 3 years from the time of the accident, you should not have to worry too much about the statute of limitations.

Stages of your lawsuit

There are different stages of your lawsuit that you may expect when the case is already on the docket of the court but the most important one would be the discovery phase and the trial proper itself. It is during these stages that the parties will have a determination of who is liable in the case and what they may get out of the lawsuit in the form of compensation.

Can I opt not to go to court and continue negotiation with the insurance company?

Yes, it depends on the strategy that your lawyer wants to take. Keep in mind that the legal strategy of every lawyer would vary. What works for one lawyer in a specific case, does not necessarily mean that it will work for another lawyer in another case.

The important thing here is to make sure that you get a lawyer who can help dive into the case and negotiate to provide you as much value as he possibly can.
