The Many Crimes Relating to Prostitution: Part Two

|

There are many crimes relating to prostitution. To properly know about every crime, we have listed them and discussed them here.

Here at Haque Legal, let us continue talking about the many crimes relating to prostitution.

Aiding, Assisting Or Abetting Another Person To Solicit, Accost, Entice, Admit Or Engage Services For Purposes Of Prostitution (MCL 750.450)

According to the previous article, soliciting, accosting, or enticing another person to engage in prostitution services is punishable. According to this specific crime, however, a person who is 16 years of age or older who “aids, assists, or abets another person to commit or offer to commit the act of soliciting, accosting, enticing, engaging or admitting for purpose of prostitution is guilty of this specific crime”

The penalty for this is punishable as follows:

  • First Offense: Misdemeanor conviction punishable by up to 93 days in jail or a fine up to $500.00, or both. MCL 750.451(1).
  • Second Offense: Misdemeanor conviction punishable by up to 1 year in jail or a fine up to $1,000.00, or both. MCL 750.451(2).
  • Third Or Subsequent Offense: Felony conviction punishable by up to 2 years in state prison or a fine up to $2,000.00, or both. MCL 750.451(3).

Keeping, Maintaining Or Operating House Of Ill-Fame Or For Purpose Of Prostitution (MCL 750.452)

Whenever a person keeps, maintains, or operates a house of ill-fame or any house or place that is eventually used for lewdness or prostitution is guilty of the crime. The penalty here is a felony conviction that is punishable by up to five years in prison or a fine of up to $5,000.00, or both.

Does this mean that the owner is also liable if the property he leased is used for prostitution?

Yes, the owner is liable but under a different crime of Leasing Houses for Purposes of Prostitution.

Leasing Houses For Purposes Of Prostitution (MCL 750.454)

If you own a property that you eventually lease out to another person and you have knowledge that the lessees intend to use the property as a house of ill-fame or knowingly permit the use of such property for such purpose, you shall be guilty of a crime punishable by a penalty of up to 6 months in jail or a fine of up to $750.

Placing Spouse In House Of Prostitution (MCL 750.456)

If you are married and you force your spouse by force, fraud, intimidation, or threat in a house of prostitution or to lead a life of prostitution, you are guilty of this crime. This is considered a felony and it is punishable by imprisonment of up to 20 years.

Detaining Person In House Of Prostitution For Debt (MCL 750.458)

If you attempt to detain or detain any person in a disorderly house or house of prostitution for the reason of the debts that such person contracted, you are guilty of this crime. As a felony conviction, this crime is punishable by imprisonment between 2 years to 20 years.

Female 16 Years Of Age Or Less In House Of Prostitution (MCL 750.462)

One gender-specific kind of crime is when a female who is 16 years of age or less is taken into a house of prostitution. This crime does not require that the sexual act be done for it to be considered as consummated, it is considered that the crime is consummated once the female steps foot inside the house of prostitution.

The conviction for this crime is punishable as follows:

  • First Offense: Misdemeanor conviction punishable by up to 93 days in jail or a fine up to $500.00, or both. MCL 750.451(1).
  • Second Offense: Misdemeanor conviction punishable by up to 1 year in jail or a fine up to $1,000.00, or both. MCL 750.451(2).
  • Third Or Subsequent Offense: Felony conviction punishable by up to 2 years in state prison or a fine up to $2,000.00, or both. MCL 750.451(3).
