In a recent turn of events, the world witnessed the Johnny Depp defamation trial. After a six-year battle against negative media and losing jobs here and there, Johnny Depp is said to have filed the case to gain his life back.
The Verdict
The verdict in the defamation trial and the rebuttal case filed against Actor Johnny Depp has been issued. Johnny won his defamation case against his ex-wife Amber Heard and it was found that Depp is entitled to $10 million in compensatory damages and punitive damages of $5 million.
The Catch
While Johnny Depp is supposed to receive a total of $15 million, he will only receive $10.35 million because Virginia state law limits punitive damages to $350,000.
What if it happens to you in Michigan?
Defamation in Michigan is defined as a ‘general term for a legal claim involving injury to one’s reputation caused by a false statement of fact and includes both libel (defamation in written or fixed form) and slander (spoken defamation).’
In succeeding articles, we will define defamation as a crime. But, how does it relate to family law practice?
Generally, the crime becomes a family law matter when it is the subject of a divorced proceeding or attributed to parties who used to be married.
In the case of Johnny Depp and his ex-wife, the events of their married life became the crux of the case because Johnny Depp was alleged to have hurt and assaulted Amber Heard during the span of their marriage.
This imputation is defamatory, according to the jury, as it has been proven by clear and convincing evidence that the allegations were false.
If this happens in your marriage, whether it be a domestic violence allegation or any statement that imputes injury against one person and harms one’s reputation, then you can sue for defamation.
Of course, your case will not be televised nor will it have the same amount of damages but it is well within your rights to sue for defamation if your name is being dragged into the mud.
