The Breath Alcohol Ignition Interlock Device (BAIID) restriction is one of the worst restrictions that you can get on your driving privileges in Michigan. If we are being honest the worst kind of restriction is probably the one where you are not allowed to drive. However, being allowed to drive but with a device installed on your vehicle may also be one of the worst things that could happen to you. 

The good thing is that this will only happen to you if you are already considered a nuisance in the state of Michigan if you are already a habitual drunk. Let us look at what will happen to you if you get this restriction on your driving.

Who is a habitual drunk?

A habitual drunk driver in the state of Michigan is properly defined by law. A habitual drunk driver has two or more convictions within 7 years and three or more convictions within 10 years. 

Individuals who have fallen into this category of a driver and are considered a habitual offender in the state of Michigan are still given a chance to drive but they would have to get the Breath Alcohol Ignition Interlock Device (BAIID) installed on their car. 

A person can have multiple driving under the influence convection and this could affect not just their driving record or their insurance premiums but their driving privileges as well. While the State of Michigan can give you a lot of chances when it comes to your driving there are a lot of limitations that would be imposed on the second and third chance. This would include the BAIID device.

What is a BAIID device?

A BAIID device or a Breath Alcohol Ignition Interlock Device is a technical device. If you have seen the use of a breathalyzer this is also almost that same thing but it is connected to the motor vehicles ignition and its other control systems in such a way that the vehicle will not start or will not even work if the blood alcohol content of the person involved is 0.25 or higher than what is allowed by law.

What are the characteristics of the BAIID device?

The BAIID device is a very strict device that is hard to use. It has the following characteristics:

  • Your vehicle will not begin if the device senses that you have a blood alcohol content of 0.025 or higher;
  • It has a camera that records the image of the person who is providing the sample so you cannot just ask someone else to take the test for you; and
  • The device is not a one-time thing that you can just remove, it requires random rolling retests.

What happens if there is a negative reading?

If there is a negative reading the best-case scenario that you can expect is that your car will just not start.

Unfortunately, alcohol reading and any violation after the installation of the device will be reported to the secretary of state as violations and you will be asked to explain this.

What if the alcohol reading is false?

If you think that the alcohol reading is false, keep a notebook on your vehicle and make sure that you have all of the facts written on it to show that you have a violation when in fact you do not.

What if someone took my vehicle with a BAIID?

If someone took your vehicle you may simply report to the police and at least have a report that says that you were not the one driving if there are any violations found.

Can I drive someone else’s car without a BAIID?

No, you are restricted to driving the car with the installed BAIID. The purpose of the device is to stop you from driving under the influence. If you try to circumvent the law by trying to drive another vehicle you may lose your driving privileges forever and also serve jail time and other penalties relevant to the case.
