So, You Want To Waive Your Immigration Interview, How?

Waiving the immigration interview is not easy. The USCIS officer will determine your eligibility for a waiver depending on a case-by-case basis.

Yes, you can waive your interview. But, only if you qualify with the criteria. 

You can waive the interview but only if you call under the following categories based on the USCIS website.

Applicants who are ineligible

When an applicant is ineligible for the naturalization benefit, the interview process will not happen. 

The naturalization process is a process. The applicant will have to go through the whole process for them to be considered eligible for the process or not. If you are ineligible for the benefit that you are applying for and your chances of getting approved are not that high, you will not get through the interview process. 

Unmarried children  (under 21 years of age) of United States Citizens

Unmarried children who are under 21 years of age and are children of United States citizens, may also no longer need to go through the interview process. 

If you filed a Form I-485 on your own or filed a Form I-485 together with your family’s adjustment applications and every applicant in that family is eligible for an interview waiver, you may no longer be required to go through the whole process of the interview.

Parents of U.S. citizens

The parents of the United States citizens may no longer be required to go through the interview process.

Unmarried children (under 14 years of age) of lawful permanent residents

The unmarried children of the lawful permanent residents who are under the age of 14 are also considered as if they filed a Form I-485 on their own or filed a Form I-485 together with their family’s adjustment applications and every applicant in that family is eligible for an interview waiver.

What if the USCIS wants to still conduct an interview?

Again, the USCIS will determine the necessity of the interview. If the USCIS determines that the interview is necessary for the applicant, the officer is allowed by law to conduct the interview. 

The same is true if the USCIS officer determines that an interview is not necessary and the applicant does not fall under any of the categories raised above. 

Military Personnel Petitioner

The USCIS officer may also waive the personal appearance of the military spouse petitioner. If the petitioner is abroad, the USCIS may look at this circumstance as valid and no longer needs any interview.

Applicants Who Are Incapacitated

When the applicant is ill or is suffering from incapacitation, the USCIS may waive the interview after supervisory approval.
