Your lawyer will give you options

Your lawyer will never jump the gun. He will first tell you about the possible options that you have. This is possible now because he has already done his investigation and he is ready to tell you about what he found out and whether your claims convinced him that there is a case to speak off.

Generally, your lawyer will be honest when it comes to the options that you have and the route that they want to take. There are now two options in the matter: whether to start the case and file the requirements or to consider negotiation with the other party. 

Negotiate Now or Later?

When it comes to any personal injury case two things could happen: you may decide to negotiate now or eventually you will negotiate later. The strategy that you have will depend primarily on what your lawyer thinks is best but generally, your lawyer especially if he is working on a contingency basis will try to get as much as he can so he can be compensated as much as he can.

You can choose to either negotiate now or file a case and open up the possibility of negotiating with the other party later on.

At this point, your lawyer will tell you whether it is better to settle the case on a specific amount that is offered or to start filing the case.

What factor does the lawyer look at to see whether it is time for the demand and negotiation?

Most of the lawyers would follow the rule that the demand and the negotiation process will only happen if the client or the person involved in the accident is already at the maximum medical improvement possible.

The maximum medical improvement is the state where the client has already ended all of the medical treatment related to the personal injury case and he has recovered from the injury. Recovery does not need to be full because this is why you are asking for compensation in the first place.

Why is the Maximum Medical Improvement concept important?

The concept of maximum medical improvement is very important because it allows you to fully comprehend what is happening. After all, you have already recovered and there is no need for you to focus anymore on other things. 

Other than that the need for a maximum medical improvement is necessary because this means that there is no more medical bill to pay for and that you were now just seeking reimbursement of the medical bills as well as all of the other non-economic damages that you suffered because of the car crash in Michigan.

What if I do not want to negotiate and continue with the case?

It is well within your decision as to the client and as the person affected by the accident to decide whether you want to negotiate or continue with the filing of the case. Either way, if you are unhappy with the negotiation and the offer of the insurance company or the person at fault then you can always continue to file the case.

The decision to accept an offer or to reject it rests primarily on the client and your lawyer can only advise you but cannot decide for you.
