Preparing For Your Hearing (So You Do Not Lose Your Driving License)

|

We have already discussed in passing the different ways that you can prepare for the hearing. We have already told you about the different answers that you should prepare for some questions and the questions that will be asked of you during the hearing.

In this article, let us talk about how you can get ready for the hearing given the new changes that have been imposed because of the coronavirus. Let us begin.

Online Hearings

Because of the coronavirus pandemic, the hearings now are conducted through an online remote system through the use of Microsoft Teams. Given the new way of attending a hearing some people no longer want to hire a lawyer because they think that they can manage the situation and handle the case on their own. This is not the case.

The only advantage of an online hearing is that it removes your exposure to the coronavirus and protects all of the parties involved in the court. It does not however diminish the burden of proof that is required of you when you apply for the reinstitution of your license.

What should you expect in the online hearing?

The expectations that you’re having for in-person hearings should be the same as the expectations during the online hearings.

The person who is applying for the reinstitution of his license still needs to present all of the circumstances relating to him and his conviction. The licensed reinstatement hearing or the appeal hearing will still consider the past, present, and future behavior of the person who is asking for the reinstatement.

Again it is a privilege to be able to drive around the state of Michigan. Every person who has been granted a license has a big responsibility and liability to the people of Michigan to make sure that she would follow all of the rules set by the legislation.

The Uniqueness of the Hearings

Since we have handled hundreds of cases relating to the institution of a license in the state of Michigan, we have seen that the proceedings before this government agency are very unique.

Not Adversarial

First, the concept of the hearings is not adversarial. You will not feel that you are being judged for you to be punished but you are being judged for the court to see if you have already learned the lesson that is being reinstated to you when your license was revoked.

It is your responsibility to make sure that you will be at ease at the time of the hearing because this would help your case a lot. With being candid comes responsibility and for you to be 100% confident at the time of the hearing you need to have the proper legal assistance. Even if the nature of the hearing is not adversarial, the proper legal assistance is what is necessary.

The Questions Will Be Very Invasive

One of the common things that people expect when it comes to hearings that are not that judicial is the fact that they would have the right to claim their right against self-incrimination. In a hearing where you are hoping to get your license restored such right is not available in some instances.

The hearing officer or the individual who will be asking you questions will have to ask you a lot of very invasive and proving questions about the history of your drinking or the history of your substance abuse or the history of your life if it feels as if it affected your driving.

We have seen a lot of cases fail because the client failed to answer the invasive questions or did not want to answer them. These are in our observation of some cases that we have seen. In the cases that we handle our clients, we make sure that they know how invasive the hearing officers may get about substance abuse.

There Is A Right Approach

We are always honest with our clients and we tell them that there is a right way to answer and there is a right approach when it comes to getting the driver’s license back in Michigan. It is not going to be very easy especially since you still need to be candid but at the same time you need to practice how you will answer the specific questions but we are always here to help.

It Is Not Just One Hearing

Some people think that because the hearing is not a criminal case for a civil case that it would just take one hearing and then the hearing officers or the judge will already make a decision. In some instances, it may happen that there would be one or two hearings that would be set to properly assess the situation and see the demeanor of the individual involved.

You have to be extra patient with the schedules and you need to have a person who will talk to the agency about the scheduling and who would ask them to schedule as soon as possible. Through the help of the right persons, you can get your license back in Michigan but it will be a process.
