The crime of Pimping refers to the following:
Pimping – ACCEPTING, RECEIVING, LEVYING, OR APPROPRIATING FROM EARNINGS OF PERSON ENGAGED IN PROSTITUTION (MCL 750.457)
A person is guilty of pimping if the prosecutor can prove all of the following elements beyond a reasonable doubt (Model Criminal Jury Instruction 20.35):
- First, that the person received or took money or something of value from a prostitute.
- Second, that the person knew that the woman was a prostitute when the person received or took money or something of value.
- Third, that the person knew when he or she received or took money or something of value, that it had been earned by prostitution.
- Fourth, that the person did not give the prostitute anything of value in exchange.
Let us look at the elements one by one.
The person received or took money from a prostitute.
When the person received or took money from a prostitute, it is considered as an element of pimping.
Here, there are two important factors: the taking or receiving of the money and that the money was taken from a prostitute.
If the individual merely admitted that he took the money or received the money, the lawyer can always say that “but is the woman or man a prostitute?”. If your lawyer can take down the assumption that the person received or took money from a prostitute, then the whole case will go into shambles.
The person knew that the woman or man was a prostitute.
Even if you took the money from a person who is a prostitute, the prosecution would need to prove that you know the fact that such person is a prostitute. If not, there will be no case to speak of.
If you have the right lawyer your lawyer will be able to bring down the case by questioning whether or not you know that the woman or the man is a prostitute. This is of course assuming that you are innocent and you indeed have no knowledge of the fact that the man or the woman was a prostitute when you received or took money from the prostitute.
The person knew when he or she received or took money or something of value, that it had been earned by prostitution.
After receiving the money or taking something of value from the person who is considered a prostitute the prosecution must also prove that you know the fact that the money that you received is indeed earned from the act of prostitution.
For example, you receive money from a person who is alleged to be a prostitute and that prostitute told you that the money came from her investment or her savings and not that it had been earned from prostitution. In this case, the prosecution’s case against he would automatically blow over because you did not know that the money that you receive has been earned from the act of prostitution.
The person did not give the prostitute anything of value in exchange.
It is also important that you know that the person did not give the prostitute anything of value in exchange for the money given and earned from prostitution is an element of the crime. A good lawyer will be able to tell the judge or the jury that you were selling something to the person which is why he or she gave you money in the first place or that he owes you money.
