Do I have to follow the parenting time schedule even during the pandemic?

Yes, the order of the judge is a very case-specific situation. You need to follow the parenting time schedule even during the pandemic. 

Of course, there are some exceptions that you may consider during the pandemic. They are the following:

The safety of the child always comes first. You need to make sure that you consider the life of your child. The exposure of one parent may be considered as a reason for you to not respect parenting time for a while. 

When the sick parent recovers, the schedule may continue. The good workaround here would be virtual visits that you document so that the other parent cannot claim that you “ghosted” your child.

Make sure that you would keep a record of the missed parenting times due to covid scare as well as any other reason for it. It is your responsibility to take note of any of the changes to your parenting time so that you will not have to deal with any of the problems that may come.

What if my ex doesn’t want me to see my child or children because of the pandemic?

If your ex was exposed to the coronavirus, we can assume that your child is also exposed to the coronavirus. Unless and until your children would have a negative Covid-19 test result, you should make sure that you do not unnecessarily expose yourself or your child.

Document this circumstance and make sure that you would still consider your child’s best interest. Missing your parenting time due to your child’s exposure to the coronavirus is valid. Just make sure that you document the exposure and the specific dates.

What if I was exposed to the coronavirus?

In general, if you are exposed to the coronavirus, you should make sure that you take care of your health first. Document your illness and make sure that you have everything validly documented. 

You must have someone who can act as a witness that you are indeed sick at a certain period and why you missed your scheduled parenting time. You should make sure that you have this specific documentation for your own protection.

What if my ex uses coronavirus to continue prohibiting me from seeing my children?

Exposure to the coronavirus can be used to prohibit you from seeing your children until your recovery. However, if you have already recovered from the virus, you should make sure that you once again get access to your children. 

If your ex continues to prohibit you, you should see to it that you get us on the phone and we should start the process of fighting for your rights again.
