Pandering in Michigan

Pimping and Pandering in Michigan are two crimes that are related to the procuring of a female prostitute for another person. 

Generally, there are two parties involved in the transactions – the pimping and pandering are proposed sexual transactions for money between two persons other than the pimp or the panderer.

Pandering may be a unique name that you have just heard but it is already part of Michigan law. 

According to the Michigan Penal Code, the following is the definition of Pandering.

Section 750.455 Pandering; felony.

Sec. 455. Pandering—Any person who shall procure a female inmate for a house of prostitution; or who shall induce, persuade, encourage, inveigle or entice a female person to become a prostitute; or who by promises, threats, violence or by any device or scheme, shall cause, induce, persuade, encourage, take, place, harbor, inveigle or entice a female person to become an inmate of a house of prostitution or assignation place, or any place where prostitution is practiced, encouraged or allowed; or any person who shall, by promises, threats, violence or by any device or scheme, cause, induce, persuade, encourage, inveigle or entice an inmate of a house of prostitution or place of assignation to remain therein as such inmate; or any person who by promises, threats, violence, by any device or scheme, by fraud or artifice, or by duress of person or goods, or by abuse of any position of confidence or authority, or having legal charge, shall take, place, harbor, inveigle, entice, persuade, encourage or procure any female person to enter any place within this state in which prostitution is practiced, encouraged or allowed, for the purpose of prostitution; or who shall inveigle, entice, persuade, encourage, or procure any female person to come into this state or to leave this state for the purpose of prostitution; or who upon the pretense of marriage takes or detains a female person for the purpose of sexual intercourse; or who shall receive or give or agree to receive or give any money or thing of value for procuring or attempting to procure any female person to become a prostitute or to come into this state or leave this state for the purpose of prostitution, shall be guilty of a felony, punishable by imprisonment in the state prison for not more than 20 years.

Any act that falls under the definition above is considered as pandering and will be dealt with by law. 

What other crimes are related to pimping and pandering?

There are also other crimes that are related to pimping and pandering, this would include the following:

Inducing a woman

Inducing a woman to become a prostitute is considered a felony in the State of Michigan. Inducing a woman does not necessarily mean that force is used for the woman to become a prostitute but the use of machinations to make a women know that she can charge money for sexual favors is considering as inducing a woman. 

What if the woman is already working as a prostitute?

If the woman is already working as a prostitute, then it is no longer considered as inducing a woman but is already pimping. 

While it is illegal, it does not fall under the description of inducing a woman.

What if there is only the sharing of profits or earnings?

A person may still be convicted in Michigan if he knowingly shared in the earnings of a known prostitute.

Transportation of a female for prostitution

It is also considered as a felony for any person to knowingly transport a female, within, through, or into the State of Michigan for the purpose of prostitution. 

While the prostitution laws in Michigan are gender neutral, this specific law is not. Michigan law does not punish an individual for transporting a male prostitute for prostitution/ 

Leasing or Maintaining A House For Prostitution

Leasing or maintaining a house for prostitution is also considered as a crime in the State of Michigan. Not only is it a crime but it is a felony.
