The 56 hour a week cap on home family provided attendant care

There is now a 56 hour a week cap on home-provided attendant care. The limitation now applies only to the care of an injured person if the care is provided in a home setting and by the family member who is living in the same household. This new limitation is one of the most controversial ones that have been set by the Michigan legislation because it puts a limitation on the number of payable hours per week that the family member can claim from the insurance.

Imagine this scenario: if you have been working for a family member and providing attendant care, the family member would probably need 24 hours of service and care. Unfortunately with the new attendant care rider, it becomes impossible for the families to still get 24 hours payable or payable attendant care services.

The good thing is that we have noticed in our practice that insurance companies have shown a willingness to sign contracts and pay family members to continue providing the attendant care services. 

Why is this the case?

In our practice, we have noticed that insurance companies are still able and willing to sign contracts and pay family members for the care of their injured loved ones. We have noticed that it might be because it is more costly to pay a commercial in-living facility than one who is at home and is being paid by the hour. 

Is this allowed by law?

Yes, it is allowed by law that the insurance companies still provide the families the right to get attendant care and pay for more than 56 hours a week. No provision in the law provides that the limitation is a limitation. It is a mere cap on what is legally allowed by law. The amended statute states that “an insurer may contract to pay for benefits for attendant care for more than the hourly limitation.”

In-home attendant care provided by family members has a 55% fee schedule for services that are not compensable under the Medicare fee schedule.
