With that, let us discuss and look at the best ways that you can prevent liability and the things that you need to do.
Inquire as to the age of your guests.
You need to always inquire as to the age of your guests. Always remember that parties can become like their own living thing. Your guests can invite other guests and they can also invite other people especially if you state that it is an open invitation party.
Other than the fact that we are still in a pandemic and it is still better to know all of the people who will attend your party, the social host liability law prevents you from just allowing anybody to enter and join your party.
If you do make an open invitation party and you want to make sure that you are not going to be liable in case a problem arises you need to make sure that you inquire as to the age of your guests.
If you are unsure about things and you do not know if the id that has been shown to you is not the id that is given to people who are already over the right age then you have all of the right to reject the guest and inform him that he should not drink any alcoholic beverage. It may be rude and some people who invited the guest me think that you are overreacting but this is what you need to do to properly protect yourself from liability
Make sure that you ask the bartender to keep an eye on the guests who are already intoxicated.
Make sure that you ask the bartender to keep an eye out on the guests who are already drunk and who are visibly intoxicated. The bartender or any person for that matter will be able to tell you properly if a person should be cut off and he should be able to the site if the person should already be cut off from drinking because the person is visibly intoxicated and may no longer drive from home.
Make sure that you assign someone who can keep an eye out for the teenagers.
You cannot guard everybody at your party but you can always have someone to keep an eye out for the teenagers who would attend your party. The teenagers may sneak out some alcoholic drinks that would lead you to think that they are just drinking drinks that to give them but that they are indeed drinking alcohol.
Prevent liability by making sure that you have someone responsible enough to be on the lookout for the teenagers.
Designate a sober driver to bring home the minors or any persons under 21 so that you can make sure that they get home safe.
If you think that there are minors that you cannot guard during the whole party you can always have someone to bring them home or get them an uber or a taxi for them to get home safely. Do not allow them to drive.
Let the guests stay until they are no longer intoxicated.
If your guest is visibly intoxicated and you want to decide to not allow them to drive, you may just want to ask them to stay for the night. If you do not want to fall asleep with someone who is visiting drunk in your home you can sit down and chat with them have coffee so that they can remove the intoxication and until the time when you think that they are already sober enough to drive you can let them drive or you can always just drive them home.
