  • A woman was picked up by a man in a public place after having coffee and discussing current affairs without the knowledge that the man is offering a sexual act in exchange for money.
  • Picking a woman, who is a hitchhiker, and you later on hit it off and had sexual acts done to each other is also possible after all. 

In both instances the fact that the person receiving the sexual conduct has no knowledge of the fact that money is needed for the sexual act to be pursued then it can be used as a defense by the person.

Why is “not knowing” a defense?

Not knowing that money is being offered or needed for the sexual act is a defense because in order to convict a person of pimping, the prosecutor is required to prove the knowledge that money is being exchanged for the act is present in the circumstances. 

Can I just deny the knowledge?

You cannot simply deny the knowledge of the fact that the sexual acts were not paid. You should keep in mind that you need a lawyer to make sure that your denial is not just an empty denial.

An empty denial is something that you should watch out for. You cannot simply deny the knowledge that there is a need for cash for the sexual conduct. You cannot simply deny the knowledge, you need a lawyer who can help you with the denial and everything.
