Criminal Sexual Conduct 2nd Degree
Criminal Sexual Conduct has a penalty of 15 years. It involves the criminal act of internationally touching someone for sexual gratification or arousal. It is touching sexually and sexually for sexual gratification, revenge, anger, or humiliation.
According to Section 750.520c, a victim of a 2nd-degree criminal sexual conduct involves the existence of power relationships and abuse of those relationships. This would involve the relationship between a teacher and a student.
The following are the individuals that may be a victim of the crime of second-degree criminal sexual conduct:
A child under 13
There is no qualifying circumstance here. As long as the child is under the age of 13, and the elements of the crime are present, it is already considered criminal sexual conduct.
A child aged 13 to 16
A child between the ages of 13 to 16 may also be a victim of the crime. When the age of the child falls in any of the following circumstances, the crime is present.
- The child who lives in your household;
- A child is related to you to the fourth degree; or
- A child with whom you have a position of authority that you used to coerce sexual contact
When the elements of a crime are present and the perpetrator of the crime work as any of the following, there is criminal sexual conduct in the second degree:
- A teacher;
- A substitute teacher;
- An administrator;
- An employee;
- A contractor; or
- A volunteer.
In any of the following circumstances, the perpetrator of the crime will be charged with criminal sexual conduct in the second degree.
- A resident or foster child in a child care facility;
- A person with a mental or physical disability;
- An individual under the jurisdiction of the Department of Corrections;
- A county prisoner or probationer; or
- An inmate waiting for a trial or hearing.
In the above, the individuals and their relationship are what is controlling the crime. In the circumstances below, you will notice that it is the circumstances of the sexual contact that makes the crime criminal sexual conduct in the second degree.
- Sexual contact that occurs in the course of committing any other felony;
- Sexual contact when the individual was armed with a weapon or an item the victim could think was a weapon;
- Sexual contact using force or coercion, and you cause injury to the victim; or
- Sexual contact that causes injury to the victim, whom you know is mentally or physically disabled.
