Common Mistakes In Case of An Accident That Could Lead To A Criminal Charge

|

When you are in an accident, you may make some common mistakes. The mistakes you make are not just in terms of the way you handle your insurance claims but mistakes that could mean criminal conviction in the long run.

With that in mind, Haque Legal wants to provide you with some common mistakes that could lead to a criminal charge.

Running Away from the Scene

Running away from the scene of the accident is one of the mistakes that you should never make. Running away from the scene is punishable in many parts of Michigan law, such as the following:

  • Section 257.618 of the Michigan Vehicle Code provides that hit-and-run accidents involving property or vehicle damage can result in a misdemeanor charge. This is considered a criminal offense in Michigan giving rise to possible criminal penalties. The penalties include up to 90 days in jail, up to $100 in fines, and potential driver’s license suspension.
  • Section 257.617a of the Michigan Vehicle Code also provides that leaving the scene of an accident that caused injury to another person is also a criminal offense. This could result in a misdemeanor charge, with possible criminal penalties including up to one year in prison, up to $1,000 in fines, and potential driver’s license suspension.
  • Section 257.617 of the Michigan Vehicle Code also provides that hit-and-run accidents involving severe bodily injury or death will result in felony criminal charges. The criminal penalties of this act include a penalty of up to 5 years in prison and potential fines of as much as $5,000, or 15 years in prison, and up to $10,000 in fines if you were at fault in the accident.

Failing to Render First Aid

Rendering first aid is required in the State of Michigan. Using case law, in People of the State of Michigan versus James Robert Noble, this issue was decided.

The following are the laws that apply in this situation:

  • M.C.L. § 257.617; MSA 9.2317 provides as follows: The driver of a vehicle who knows or who has reason to believe that he or she has been involved in an accident upon either public or private property, when the property is open to travel by the public, resulting in serious or aggravated injury to or death of a person shall immediately stop his or her vehicle at the scene of the accident and shall remain there until the requirements of section 619 are fulfilled.
  • MCL 257.619; MSA 9.2319 provides: The driver of any vehicle who knows or who has reason to believe that he has been involved in an accident resulting in injury to or death of any person or damage to any vehicle which is driven or attended to by any person shall give his name, address, and the registration number of the vehicle he is driving, also the name and address of the owner, and exhibit his operator’s or chauffeur’s license to the person struck or the driver or occupants of any vehicle collided with and shall render to any person injured in such accident reasonable assistance in securing medical aid or transportation of an injured person or persons.
  • Section 30 of a 1929 statute required the driver to stop at the scene, give his name, address, registration number, and the name and address of the vehicle’s owner, and show his license to the people in the car.

These are two common mistakes that you should prevent if you are driving in the State of Michigan.
