Basics of Adoption-Related Immigration in Michigan

When it comes to immigration, one of the most common reasons for it is family.

There are two kinds of family-based immigration that are related to adoption. There is the Haque process and the United States Adopted Child Under the Family-Based Petition Process. 

According to the United States Citizenship and Immigration Services, the processes of the two are very different. 

Orphan Process: Adopted Child Under the Family-Based Petition Process

The Adopted Child Under the Family-Based Petition Process is also known as the Orphan Process. The Orphan Process is used by any United States citizen who establishes that they will provide proper parental care to the child.

According to the USCIS website, you will be required to establish the following:

  • That the child whom you have adopted or plan to adopt is an “orphan” as defined in U.S. immigration law;
  • That you have adopted the child abroad, and that at least 1 of you personally saw and observed the child before or during the adoption proceedings; or
  • That you will adopt the child in the United States after the child arrives in the United States (you must have permission to bring the child out of his or her own country and to the United States for adoption)

This process begins by filling up the information provided on Form I-600, Petition to Classify Orphan as an Immediate Relative, to determine whether a child who has been or will be adopted by a U.S. citizen can be classified as an orphan for an immediate relative immigrant visa.

Hague Process

The second process is the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (Hague Adoption Convention). 

The Hague Adoption Convention is an international treaty that provides important safeguards to protect the best interests of children, birth parents, and adoptive parents in intercountry adoptions.
